Motorcycle Accidents

We push back on the bias riders face after a crash and build cases on evidence, not assumptions.

Motorcyclists are among the most vulnerable people on Michigan roads. You are exposed. You are smaller than every other vehicle around you. And when a careless driver makes a mistake, you are the one who pays the price with your body. The injuries from motorcycle accidents are often catastrophic, and the road to recovery can be long, expensive, and deeply painful.

What makes it worse is that riders are frequently blamed for accidents they did not cause. Insurance companies are quick to assume that a motorcyclist was speeding, weaving, or being reckless, and they use that assumption to deny or minimize claims. It is a bias that is as unfair as it is common, and it is exactly the kind of fight that Hamo Law was built for.

For over 40 years, Hamo Law Firm has stood up for injured people across Michigan against insurance companies and corporations that try to avoid accountability. We have recovered more than $250 million for our clients, and we bring that same relentless advocacy to every motorcycle accident case we handle. If you were injured on your bike because of someone else's negligence, we want to hear your story.

Why Motorcycle Accidents Are Different

Not all vehicle accident cases are the same, and motorcycle cases come with a unique set of challenges that require an attorney who understands them. Riders do not have airbags, crumple zones, or a steel frame around them. When the collision happens, there is nothing between them and the pavement. The result is that motorcycle accidents produce some of the most severe and life-altering injuries seen in any personal injury practice.

Beyond the physical reality, motorcyclists face a legal and cultural bias that car accident victims do not. Police reports may characterize rider behavior in ways that favor the other driver. Insurance adjusters arrive at the scene of a claim already skeptical. Jurors sometimes carry preconceived notions about motorcyclists that have nothing to do with the facts of the case.

Michigan's No-Fault Law and Motorcycle Riders

Michigan's no-fault auto insurance system works differently for motorcyclists than it does for drivers of passenger vehicles, and this distinction has enormous consequences for injured riders.

Motorcycles are not required to carry Personal Injury Protection (PIP) insurance under Michigan law. This means that after an accident, riders cannot automatically turn to their own motorcycle insurance policy for the no-fault medical and wage loss benefits that car drivers receive. Instead, a motorcyclist's path to no-fault coverage typically depends on one of the following:

  • A resident relative's auto insurance policy, if the rider lives with someone who carries Michigan no-fault coverage
  • The Michigan Assigned Claims Plan, a state-administered program that provides limited benefits to injured people who have no other source of coverage
  • The at-fault driver's liability insurance, which becomes the primary source of compensation in most motorcycle accident claims

What Compensation Can You Recover?

Motorcycle accident victims are often entitled to significant compensation, but the full picture of what is recoverable is not always obvious in the aftermath of the crash. An experienced attorney ensures that every category of damages is identified and pursued.

Depending on the facts of your case, you may be able to recover:

  • Medical expenses, including emergency treatment, hospitalization, surgery, specialist care, physical and occupational therapy, and future medical costs related to your injuries
  • Lost wages for the time you are unable to work while recovering
  • Loss of earning capacity if your injuries prevent you from returning to the same level of work you performed before the accident
  • Pain and suffering, including physical pain, emotional distress, anxiety, depression, and loss of enjoyment of life
  • Motorcycle damage, as well as the cost of replacing protective gear such as your helmet, jacket, gloves, and boots that were destroyed in the crash
  • Attendant care benefits if your injuries require you to have assistance with daily living activities
  • Wrongful death damages for surviving family members, including funeral and burial expenses, loss of financial support, and loss of companionship and consortium

Why Choose Hamo Law for Your Motorcycle Accident Case

We Take Motorcycle Cases Seriously

Some firms treat motorcycle cases as lower-priority personal injury matters. We do not. We know the severity of these injuries, we understand the unique legal landscape that Michigan riders face, and we have the experience to pursue these cases all the way through trial if that is what it takes.

We Fight Rider Bias Head-On

We anticipate the argument that you were reckless, that you were speeding, or that you put yourself at risk by riding at all. We prepare for those arguments from day one, gathering evidence, working with accident reconstruction specialists when needed, and building a case that puts the responsibility where it belongs: on the driver who failed to see you.

What to Do After a Motorcycle Accident in Michigan

The steps you take in the immediate aftermath of a motorcycle accident can have a lasting effect on your ability to recover full compensation. Here is what we advise:

  • Get medical help immediately. Even if you feel like you can walk it off, get evaluated. Adrenaline masks pain, and serious injuries like TBIs and internal trauma may not be apparent right away. A prompt medical record also ties your injuries directly to the crash.
  • Do not remove your helmet at the scene unless medical personnel instruct you to do so. Your helmet may contain evidence about the nature and angle of the impact.
  • Call the police and stay at the scene. Make sure an official report is filed and get the report number before you leave.
  • Document everything you can. Take photos of the road, your motorcycle, the other vehicle, any skid marks or debris, road conditions, traffic signs, and your injuries. If bystanders witnessed the crash, get their names and contact information.
  • Do not give a recorded statement to the other driver's insurance company. They will use anything you say to reduce or deny your claim.
  • Preserve your gear. Do not discard your helmet, jacket, or any other clothing worn during the accident. These items can serve as evidence.
  • Contact Hamo Law before accepting anything. Insurance companies often reach out quickly with settlement offers designed to close your claim before you understand its full value. Do not sign anything until you have spoken with us.

You Rode. You Got Hit. Now Let Us Fight.
