Hamo Law Firm

When a serious auto accident turns your life upside down, everything happens fast. The ambulance. The phone calls. The insurance adjuster who seems to materialize out of nowhere. It feels like the world keeps spinning even though yours has stopped.

Most people in that moment have no idea what their rights are. They do not know what they are entitled to. And the other side is counting on that. Insurance companies are billion-dollar businesses with teams of attorneys whose job is to pay you as little as possible. That is not a conspiracy theory. That is just how the game is played.

For over 40 years, we have been playing a different game. At Hamo Law, we represent Michigan auto accident victims across the state. George Hamo and Alex Hamo have built this firm on one promise: when you come to us, you get us. Not a paralegal. Not a case manager. You get a trial attorney who knows your name, knows your file, and knows exactly how to fight for you.

Michigan Auto Accidents: What You Are Really Up Against

Michigan roads see thousands of serious crashes every year. According to the Michigan Department of Transportation (MDOT), there are tens of thousands of injury crashes in the state annually. Many of those crashes leave victims with injuries that change their lives permanently.

The financial stakes are enormous. Medical bills pile up fast. Lost wages follow. And then the insurance company calls with a number that sounds like a lot until you realize it barely covers your first month of treatment.

Here is what most people do not understand:

  • The insurance adjuster who contacts you works for the insurance company, not for you.
  • Anything you say to that adjuster can be used to minimize or deny your claim.
  • A quick settlement offer is almost always lower than what your case is actually worth.
  • Once you sign a release, you cannot go back for more money, no matter how much worse your injuries get.

How Michigan No-Fault Insurance Actually Works

Personal Injury Protection (PIP) Benefits

PIP benefits are the foundation of Michigan's No-Fault system under MCL 500.3105. They cover medical expenses, lost income, and replacement services for injured accident victims.

Michigan's 2019 No-Fault reform (effective July 2020) changed the PIP landscape significantly. Drivers now choose their PIP coverage level from several tiers:

  • Unlimited PIP: Covers all reasonably necessary medical expenses with no cap.
  • $500,000 PIP: Caps medical benefits at $500,000 per person per accident.
  • $250,000 PIP: Caps at $250,000, with an option to exclude coverage if you have qualifying health insurance.
  • $50,000 PIP: Available only to Medicaid recipients.
  • PIP opt-out: Available only to Medicare Part A and B recipients.

What PIP Covers

PIP benefits can cover a wide range of losses after an accident. Under MCL 500.3107, covered benefits may include:

  • Reasonable and necessary medical treatment and rehabilitation
  • Up to 85% of lost wages for up to three years after the accident
  • Replacement services for household tasks you can no longer perform (up to $20 per day)
  • Attendant care if you need someone to assist with daily living activities

What PIP Does NOT Cover

PIP does not cover everything. Pain and suffering, emotional distress, and certain excess economic losses are not part of No-Fault benefits. To pursue those damages, you typically need to file a third-party liability claim against the at-fault driver.

When You Can File a Third-Party Claim

Michigan law allows you to sue the at-fault driver for pain and suffering damages if your injuries meet the "serious impairment of body function" threshold under MCL 257.1301. This means your injury must affect your ability to lead your normal life. Proving that threshold is not always simple. We know how to build that case.

What Happens After a Michigan Auto Accident: The Legal Process

Immediate Steps After a Crash

If you are physically able, taking the right steps at the scene can protect your rights significantly.

  • Call 911 and request medical attention, even if you feel okay. Adrenaline masks pain.
  • Document the scene. Take photos of vehicles, road conditions, and visible injuries.
  • Get the other driver's insurance and contact information.
  • Gather names and contact information from any witnesses.
  • Do NOT give a recorded statement to any insurance company before speaking with an attorney.

Filing Your No-Fault PIP Claim

You must notify your own insurance company promptly after an accident. Under Michigan law, you typically have one year from the date of the accident to submit a written claim for No-Fault benefits. Missing that deadline can cost you everything.

Insurance companies deny and delay PIP claims far more often than most people realize. Common reasons include:

  • Claims that treatment was not "reasonably necessary"
  • Disputes about whether your injury is related to the accident
  • Paperwork errors or missed deadlines
  • Policy exclusions that were buried in the fine print

Filing a Third-Party Liability Claim

If your injuries meet the serious impairment threshold, we can pursue the at-fault driver for additional damages. These may include pain and suffering, excess medical expenses, and more.

Michigan follows a modified comparative fault rule under MCL 600.2959. You can recover damages as long as you are not more than 50% at fault. However, your recovery will be reduced by your percentage of fault. We build cases that minimize your share of fault and maximize the other side's accountability.

The Investigation and Litigation Phase

Strong cases are built on strong evidence. Here is what our investigation typically involves:

  • Obtaining the police report and any 911 call records
  • Securing witness statements early, before memories fade
  • Reviewing medical records and working with treating physicians
  • Consulting accident reconstruction experts when needed
  • Analyzing the at-fault driver's history, phone records, and driving behavior

The Insurance Company Playbook (And How We Counter It)

Insurance companies are not your friends after a serious accident. They are businesses. Their goal is to protect their bottom line.

After more than four decades of fighting these companies, we have seen every tactic they use.

  • The quick settlement offer: It comes fast, before you know the full extent of your injuries. It is almost always far less than your case is worth.
  • The recorded statement trap: An adjuster calls and asks you to describe what happened. What you say gets used to minimize your claim. Never give a recorded statement without an attorney.
  • The Independent Medical Exam (IME): The insurer sends you to their own doctor. That doctor's job is to find reasons to limit or deny your benefits. We push back hard on these reports.
  • Surveillance: Insurers sometimes hire investigators to follow claimants and record them. A video of you taking out the trash can be twisted into "proof" that you are not really hurt.
  • Social media monitoring: Photos and posts can be taken out of context and used against you. Lock down your accounts immediately after a crash.

You Deserve Someone in Your Corner

A serious auto accident does not just injure your body. It disrupts your finances, your career, your family, and your sense of security. The road back can feel impossibly long. And when the insurance company starts pressuring you to settle quickly, it can feel like the walls are closing in.

That is exactly where we come in. We think of ourselves as a bridge. Our job is to walk with you from the worst moment of your life to the other side of it, where you have the resources and the resolution you deserve. That walk is not always easy. But you should not have to take it alone.

Your Next Step Starts with One Call

If you or someone you love has been seriously injured in a Michigan auto accident, do not wait. Evidence disappears. Deadlines approach. And every day that passes is a day the other side uses to strengthen their position.
