FAQs

What rights do pedestrians have when they're hit by a car after dark in Michigan?

Pedestrians have every right to be on Michigan streets, and drivers owe them real care, especially at night. Michigan drivers must use headlights from a half hour after sunset until a half hour before sunrise. They must also watch for people in crosswalks and drive at speeds that let them stop safely. A driver who was speeding, distracted, or failed to yield may be held responsible.

As a pedestrian, you generally have access to No-Fault PIP benefits even though you weren't in a car. Those benefits usually come from your own auto policy or a household relative's policy. If no one in your home has auto insurance, you may still apply through the Michigan Assigned Claims Plan.
