It's a sinking feeling to learn the driver who hurt you has little or no insurance. The good news is that your recovery doesn't end there. Michigan's No-Fault system still provides PIP benefits for medical care and lost wages through your own policy, regardless of the other driver's coverage.
For pain, suffering, and losses beyond PIP, you have a few possible paths:
- Uninsured motorist (UM) coverage on your own policy may pay what the at-fault driver should have.
- Underinsured motorist (UIM) coverage may fill the gap when the other driver's limits are too low for your injuries.
- The vehicle owner's policy could apply if someone else's car was being driven.
- An employer's commercial policy may come into play if the driver was working at the time.
UM and UIM coverage is optional in Michigan, so check your declarations page. These claims are made against your own insurer, which may fight you just as hard as a stranger's company would. Policies also set their own notice deadlines, so read yours early or let us read it with you.
