Michigan falls are beautiful until the sidewalk turns into a slick sheet of wet leaves or black ice. Property owners know this happens every year, and they have a duty to deal with it reasonably. You may have a claim when a business or landlord failed to clear, salt, warn, or fix a known hazard.
The law here shifted in 2023. In Kandil-Elsayed v. F & E Oil, the Michigan Supreme Court ruled that an "open and obvious" hazard no longer automatically ends a case. Instead, how visible the danger was now factors into fault and comparative negligence.
Michigan landlords must keep common areas, like parking lots and walkways, fit for their intended use (MCL 554.139). If you fell on public property, such as a city sidewalk, much shorter notice deadlines may apply.
